Remote EMS Terms and Conditions for AED Servicing and First Aid Kit Maintenance

1. DEFINITIONS

"Remote EMS" refers to the service provider, operating under the registered business name Remote EMS.
"Client" refers to the individual or entity engaging Remote EMS for AED servicing and/or first aid kit maintenance.
"AED" refers to an Automated External Defibrillator.
"OEM" means Original Equipment Manufacturer.
"Services" refers to AED maintenance (pad and battery replacement) and first aid kit restocking and compliance checks.

2. SCOPE OF SERVICES

Remote EMS provides non-invasive servicing of AEDs and workplace first aid kits, including:

  • Replacement of AED batteries and electrode pads using OEM parts.

  • Visual inspection of AEDs for physical damage, status indicators, expiry dates, and environmental readiness.

  • First aid kit inspection, restocking, and replacement of expired or missing items in accordance with Safe Work Australia recommendations and workplace risk categories.

  • Record-keeping and reporting of service outcomes and future service requirements.

Remote EMS does not provide:

  • Internal AED repairs, diagnostics, or component-level servicing.

  • Certified electrical or biomedical servicing under AS/NZS 3551.

  • Legal compliance certification of AEDs or first aid kits beyond the scope of pad/battery replacement and supply checks.

3. CLIENT RESPONSIBILITIES

The Client is responsible for:

  • Providing accurate information regarding workplace risk levels, kit requirements, and AED usage history.

  • Ensuring AEDs and first aid kits are stored in an accessible, appropriate, and safe location.

  • Notifying Remote EMS of changes in site risk profiles, equipment faults, or equipment use between scheduled services.

  • Ensuring appropriate personnel are informed of the AED and first aid kit location and trained in their use where required.

4. USE OF OEM COMPONENTS

Remote EMS only installs AED parts (pads and batteries) that are:

  • Supplied by or authorised by the AED's manufacturer (OEM).

  • Within expiry and free from visible damage or defects.

Remote EMS does not install third-party parts unless explicitly authorised by the Client in writing. The Client assumes all risk for any device malfunction or legal liability resulting from use of non-OEM parts.

All AED parts are custom-ordered, and payment is required upon order confirmation. While some commonly used components may be held in stock, due to expiry dates on critical items, Remote EMS prefers to order parts specifically for each job. Remote EMS holds no liability for delays in shipping or supply from the manufacturer. The Client acknowledges that Remote EMS is not liable for the operational readiness of AEDs that are awaiting ordered components.

5. SERVICE INTERVALS & SCHEDULING

Standard service intervals:

  • AEDs: Every 6 or 12 months depending on manufacturer guidelines and workplace needs.

  • First aid kits: Quarterly (every 3 months) or more frequently if required by high-risk operations.

Remote EMS will schedule visits based on agreement with the Client, but the Client is ultimately responsible for ensuring timely maintenance and monitoring devices between services.

6. REPORTING AND DOCUMENTATION

Remote EMS provides a written report for each service visit, including:

  • Date and location of service.

  • AED model and serial number.

  • Expiry dates of replaced components.

  • First aid kit stock status and items replaced.

  • Any faults or issues identified.

  • Recommendations for next service or additional follow-up.

This report is for informational purposes only and does not constitute formal certification or compliance under any health or safety regulations.

7. LIMITATION OF LIABILITY

Remote EMS shall not be liable for:

  • Device failure due to causes outside of our control (e.g. improper storage, tampering, physical damage, manufacturing defects).

  • Use of expired or damaged AED pads/batteries after service, if due to client negligence or delayed service intervals.

  • Failure of AED or first aid supplies to perform during an emergency.

  • Injury, death, or loss arising from misuse or failure to use AEDs or first aid kits.

Maximum liability of Remote EMS, under any legal claim, is limited to the amount paid by the Client for the specific service provided.

8. INDEMNITY

The Client agrees to indemnify and hold harmless Remote EMS, its employees, contractors, and agents, against all claims, losses, damages, or legal action resulting from:

  • Use or misuse of AEDs or first aid kits after service.

  • Use of non-OEM parts at Client request.

  • Delay in service due to Client unavailability or inaccurate information.

9. DISPUTES

Any disputes will first be attempted to be resolved between parties in good faith. If resolution is not achieved, disputes will be handled in accordance with the applicable laws of New South Wales, Australia.

10. ACCEPTANCE OF TERMS

By engaging Remote EMS for any AED or first aid servicing, the Client agrees to these Terms and Conditions. These may be updated periodically and notice will be provided in writing where changes affect ongoing agreements.
